According to the Austrian Law on Counterfeiting, which is based on the EC Counterfeiting Regulation 1383/2003, the owner of an IP-right can apply for border measures against goods that are suspected of infringing IP-rights.
Border measures are applicable with respect to any IP rights, particularly trademarks, registered designs, patents, supplementary protection certificates, as well as copyrights. It comprises particularly counterfeited goods, labels, packages, as well as molds and dies for the manufacturing of counterfeited goods.
Any application for border measures has to be directed to the customs authority in Villach, Carinthia.
